Making a Will is easy and yet many people die without having made any provision for the distribution of their assets in a properly drafted Will. It makes sense to make a Will - you decide how you want your property to be allocated after your death and can prevent it being taken over by the state. Your solicitor can assist you to make your Will. If you are planning to make a bequest to STARescue and are using a preprinted Will form available from the stationers then you may like to use the wording below.
A residuary legacy allocates a set share or percentage of your whole estate, after all of your debts and funeral expenses have been paid, and any other legacies have been made. This type of gift in your Will means that however much your financial circumstances change, the proportion of your estate, by share or percentage, that each beneficiary receives will stay the same. This is the best possible way to leave a gift to STARescue. If this is your wish, the following wording in your will would make this clear:
"I leave (the whole) or (percentage) of my residuary estate to STARescue, The Small Animal Welfare Charity of Basingstoke, Registered Charity No. 1075974, for the general charitable purposes of that Trust and I declare that the receipt of the person appearing to be a proper Officer of the Trust shall be a good discharge to my Trustees."
A legacy to STARescue of a fixed sum of money is called a “pecuniary legacy”. This is most appropriate where you wish to leave a definite cash sum to us. Because of the effects of inflation a legacy like this may have lost real value by the time of your death, however, by including the words "index linked" after the stated amount, your legacy is protected from the effects of inflation. The following wording, included in your Will, makes this clear:
"I give absolutely a pecuniary legacy of (words) (£ .......) index-linked to STARescue, The Small Animal Welfare Charity of Basingstoke, Registered Charity No. 1075974, for the general charitable purposes of that Trust and I declare that the receipt of the person appearing to be a proper Officer of the Trust shall be a good discharge to my Trustees."
It is possible to leave a specific item as a legacy in your Will. This is known as a specific legacy – for example, a piece of jewellery, or a painting. Normally, you would leave this to STARescue because you know that we would be able to use the item for our work, or because we would be able to sell the item and use the sale proceeds towards our work. If this is your wish, the following wording in your will would make this clear:
"I make the following charitable gift absolutely to STARescue, The Small Animal Welfare Charity of Basingstoke, Registered Charity No. 1075974, (a clear description of the item(s) to be bequeathed), with the full power to realise such assets and to apply the proceeds to the general purposes of the Charity, and I direct that a receipt of the treasurer or other officer at STARescue shall be a good and sufficient discharge of my Executors."
